Terms and Conditions

These Terms and Conditions are a legal agreement between the user and Next Level Sports Hub LLC, doing business as Next Level Sports and/or Next Level Sports Hub. By accessing or using the website, mobile application, platform, athlete tools, coach tools, training programs, AI-assisted program generation, testing features, rankings, subscriptions, messaging tools, or any related services, the user agrees to these Terms. If a user does not agree to these Terms, the user must not access or use the platform. If the user is using the platform on behalf of a company, gym, team, school, club, facility, or organization, the user represents that they have authority to bind that organization to these Terms.

Next Level Sports is a sports-performance platform that may provide: • Athlete profiles • Coach profiles • Performance tracking • Training program tools • AI-assisted program generation • Testing and rankings • Coach-athlete connection tools • Team, gym, school, club, or organization tools • Subscription features • Communication features • Performance-development resources Next Level Sports is not a medical provider, healthcare provider, physical therapy provider, recruiting agency, employment agency, school, university, sports federation, or professional league.

Users must be legally able to agree to these Terms. Users must provide accurate information during signup and account use. Users may not use the platform if they are prohibited from doing so under applicable law. Users under 18 may use the platform only with appropriate permission from a parent or legal guardian where required. Users under 13 may not create independent accounts unless Next Level Sports has implemented a legally compliant parent-managed account process.

To access certain features, users must create an account. Users agree to: • Provide accurate and current information • Keep login credentials secure • Not share accounts without permission • Update account information when necessary • Notify Next Level Sports of unauthorized access • Use the platform only for lawful purposes Users are responsible for all activity under their account. Next Level Sports may suspend or terminate accounts that provide false information, violate these Terms, misuse the platform, or create safety, legal, security, or operational risk.

The platform may include different user types, including: • Athletes • Coaches • Parents or guardians • Teams • Gyms • Clubs • Schools • Facilities • Organizations • Admin users Different user types may have different features, permissions, pricing, responsibilities, and restrictions.

Athletes agree to: • Provide accurate profile and performance information • Use the platform safely and responsibly • Follow training programs with proper judgment • Stop training if they experience pain, dizziness, injury symptoms, or unsafe conditions • Consult a qualified medical professional before training with injuries, medical issues, or physical limitations • Respect coaches and other users • Not falsify testing results • Not misuse rankings or verification features • Not upload unlawful, harmful, false, or unauthorized content • Not share private login credentials Athletes understand that sports training carries risk, including injury.

Coaches agree to: • Provide accurate qualifications, experience, pricing, and profile information • Work within their professional competence • Respect athlete privacy • Access athlete data only with proper permission • Avoid medical diagnosis unless legally qualified • Avoid unsafe training recommendations • Communicate professionally • Follow all applicable laws and sport rules • Honor pricing and service representations • Avoid deceptive recruiting or sales practices • Avoid harassment, discrimination, exploitation, or abusive conduct • Avoid inappropriate communication with minors • Keep athlete data confidential • Not sell, export, publish, or misuse athlete data Coaches are independent users or independent service providers unless separately contracted by Next Level Sports in writing. Next Level Sports does not guarantee the quality, safety, qualifications, certifications, background, availability, or results of any coach unless expressly stated in writing.

Parents and guardians are responsible for: • Supervising minor users • Reviewing minor account activity • Approving appropriate coach relationships • Monitoring training safety • Providing consent where required • Ensuring minor users understand platform rules • Contacting Next Level Sports with privacy or safety concerns Parents and guardians understand that training and athletic activity carry risk.

Next Level Sports provides sports-performance information, training tools, tracking systems, and program-generation features. Next Level Sports does not provide: • Medical advice • Diagnosis • Treatment • Physical therapy • Rehabilitation • Return-to-play clearance • Nutritional medical advice • Mental health treatment • Emergency services Users should consult a physician, physical therapist, athletic trainer, or other qualified healthcare professional before beginning any training program, especially if they have pain, injury, illness, medical conditions, pregnancy, disability, limitations, or concerns. Users participate in training at their own risk. Next Level Sports does not guarantee injury prevention, performance improvement, recruitment, scholarship opportunities, coach placement, team placement, or professional outcomes.

The platform may use artificial intelligence, automation, or algorithmic tools to help generate training programs, exercise suggestions, testing suggestions, progression models, or performance insights. AI-assisted outputs are informational and supportive only. Users understand and agree that: • AI output may be incomplete, inaccurate, or inappropriate for a specific user • AI output is not medical advice • AI output does not replace qualified coaching judgment • AI output does not guarantee results • Users must apply personal judgment and safety awareness • Athlets/Coaches should review AI-generated programs before starting/assigning them when appropriate • Users should not follow any recommendation that feels unsafe or causes pain Next Level Sports may update, modify, restrict, or discontinue AI features at any time.

Next Level Sports may offer free and paid subscription tiers. Paid features may include, depending on the plan: • AI program generation • Advanced profile features • Performance tracking • Testing tools • Rankings • Coach discovery • Coach program tools • Team or organization tools • Analytics • Premium support • Other platform features Pricing, features, limits, and availability may change over time. Users agree to pay all applicable subscription fees, taxes, and charges associated with their selected plan.

Paid subscriptions may renew automatically unless canceled before the renewal date. By purchasing a subscription, the user authorizes Next Level Sports or its payment processor to charge the selected payment method. Users may cancel according to the cancellation process provided in the platform. Cancellation stops future renewal charges but does not automatically require a refund for past charges unless required by law or expressly stated in the refund policy. If payment fails, Next Level Sports may restrict, downgrade, suspend, or terminate access to paid features.

Refund terms should be displayed clearly at checkout. Unless otherwise required by law or stated in a specific promotion, subscription payments may be non-refundable once the billing period begins. Next Level Sports may provide refunds, credits, or exceptions at its discretion. Users in certain countries may have mandatory cancellation or withdrawal rights. Nothing in these Terms limits mandatory consumer rights that cannot legally be waived.

Coaches may offer independent services through or in connection with the platform. Coach service fees may be: • Charged directly by the coach • Charged through the platform • Subject to platform fees • Subject to separate coach-athlete agreements • Subject to taxes, cancellation rules, and refund rules Unless expressly stated otherwise, coaches are responsible for delivering their own services and complying with applicable laws. Next Level Sports may facilitate payments, visibility, or communication but does not guarantee coach results, athlete outcomes, or service quality.

Next Level Sports may charge platform fees, subscription fees, transaction fees, service fees, or processing fees. Any applicable platform fees should be disclosed before payment. Next Level Sports may change fees with notice where required.

Athlete profiles are private by default unless the athlete changes visibility settings or joins features that require sharing. Users are responsible for choosing what information they make visible. Next Level Sports may provide visibility settings such as: • Private profile • Coach-discoverable profile • Team profile • Showcase profile • Public profile Public profile features may be restricted for minors. Next Level Sports may remove or restrict profile content that violates these Terms, creates safety risks, infringes rights, or violates law.

The platform may allow users to submit, track, verify, and compare performance testing results. Users agree not to falsify, manipulate, or misrepresent testing data. Rankings may be based on submitted data, coach-verified data, system calculations, sport category, age group, gender category where applicable, location, team, or other criteria. Next Level Sports does not guarantee that rankings are error-free. Rankings are for platform engagement, performance tracking, and comparison purposes only. Next Level Sports may remove, adjust, flag, or review testing results suspected to be false, manipulated, unsafe, or inconsistent with platform rules.

Users may communicate through platform messaging or contact tools. Users agree not to send messages that are: • Harassing • Threatening • Sexual toward minors • Discriminatory • Abusive • Fraudulent • Exploitative • Spam • Deceptive • Illegal • Unsafe • Invasive of privacy Next Level Sports may review messages when necessary for safety, support, abuse reports, legal compliance, fraud prevention, or enforcement of these Terms. Users should not share sensitive personal information, passwords, financial details, medical details, or private contact information in platform messages unless necessary and safe.

Users must not exploit, harass, groom, manipulate, pressure, or communicate inappropriately with minors. Coaches and adult users must maintain professional boundaries with minor athletes. Next Level Sports may restrict: • Minor profile visibility • Minor messaging • Coach discovery for minors • Public rankings for minors • Sharing of contact information • Off-platform communication Violations involving minors may result in immediate account termination, reporting to authorities where appropriate, and legal action.

Users may upload, post, submit, create, or link content, including: • Profile photos • Highlight videos • Training videos • Performance data • Coach programs • Exercise notes • Messages • Reviews • Comments • Feedback • Logos or team materials where authorized Users retain ownership of their own content. By submitting content to the platform, users grant Next Level Sports a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, process, transmit, adapt, and use the content as necessary to operate, improve, secure, and promote the platform, subject to privacy settings and applicable law. Users represent that they have all rights needed to submit their content.

Coaches may create programs, templates, workouts, exercise descriptions, notes, and other coaching materials. Unless otherwise agreed in writing: • Coaches retain ownership of their original coaching content • Next Level Sports may host and display coach content through the platform • Athletes may access assigned coach content according to their account and subscription permissions • Coaches may not upload content they do not have the right to use • Coaches may not copy or misuse platform-owned templates, systems, or proprietary materials outside authorized use

Next Level Sports owns or licenses the platform, brand, software, design, interface, workflows, AI systems, scoring structures, templates, content, logos, trademarks, trade names, graphics, databases, and proprietary features. Users may not: • Copy the platform • Reverse engineer the platform • Scrape the platform • Resell platform access • Use the brand without permission • Copy proprietary templates or systems • Build a competing product using unauthorized platform data • Remove copyright or trademark notices • Misuse Next Level Sports intellectual property

Users may not: • Violate any law • Misuse athlete data • Harass or threaten others • Upload harmful content • Upload malware • Attempt unauthorized access • Scrape or harvest data • Create fake accounts • Impersonate others • Misrepresent qualifications • Falsify test results • Sell or share private user data • Circumvent payment systems • Interfere with platform security • Spam users • Use the platform for illegal recruiting • Use the platform for discrimination • Use the platform to exploit minors • Use bots or automated access without permission

Users may not upload or share content that: • Is illegal • Is sexually explicit involving minors • Exploits or endangers minors • Is hateful or discriminatory • Harasses or threatens others • Encourages self-harm • Promotes unsafe training practices • Contains private information without consent • Infringes intellectual property rights • Contains malware or malicious code • Is deceptive or fraudulent • Misrepresents athletic ability, certification, or identity Next Level Sports may remove prohibited content and restrict accounts.

The platform may connect to or use third-party services such as: • Payment processors • Email providers • Analytics tools • AI providers • Cloud hosting providers • Social media platforms • Video platforms • Coach websites • Calendar tools • Communication tools Next Level Sports is not responsible for third-party services that it does not own or control. Use of third-party services may be subject to separate terms and privacy policies.

Next Level Sports may release beta, test, experimental, or early-access features. Beta features may be incomplete, limited, unstable, or changed without notice. Next Level Sports may modify, suspend, or remove beta features at any time. Users should not rely on beta features for critical decisions.

Next Level Sports may allow athletes to showcase performance data, highlight reels, rankings, and profiles. Next Level Sports does not guarantee: • Coach discovery • Scout attention • Recruiting outcomes • Scholarship offers • Professional contracts • Team selection • Performance improvement • Verification acceptance • Ranking placement • Athletic success Users are responsible for complying with school, college, federation, league, NCAA, NIL, amateur-status, transfer, recruiting, and eligibility rules that apply to them.

Next Level Sports is based in the United States. Users outside the United States are responsible for complying with local laws. Next Level Sports may limit platform features, subscriptions, payments, rankings, coach access, or availability in certain countries or regions. Nothing in these Terms limits mandatory consumer protection rights that apply in a user's country and cannot legally be waived.

Use of the platform is also governed by the Next Level Sports Privacy Policy. The Privacy Policy explains how Next Level Sports collects, uses, stores, protects, and shares personal information. By using the platform, users acknowledge the Privacy Policy.

Next Level Sports may suspend, restrict, or terminate access if a user: • Violates these Terms • Violates the Privacy Policy • Violates coach or athlete conduct rules • Creates safety risks • Misuses athlete data • Fails to pay fees • Provides false information • Infringes intellectual property rights • Harasses or harms others • Engages in fraud • Misuses minor accounts • Violates applicable law Users may stop using the platform at any time and may request account deletion according to the Privacy Policy. Certain sections of these Terms will survive termination, including payment obligations, intellectual property, disclaimers, liability limitations, dispute resolution, and privacy-related obligations.

The platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Next Level Sports disclaims warranties of: • Fitness for a particular purpose • Merchantability • Non-infringement • Accuracy • Availability • Reliability • Security • Performance outcomes • Coaching outcomes • Recruiting outcomes • Injury prevention Next Level Sports does not guarantee that the platform will be uninterrupted, error-free, secure, or free from harmful components.

To the maximum extent permitted by law, Next Level Sports and its owners, officers, employees, contractors, partners, vendors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost opportunities, injury-related damages, reputational harm, or business interruption. To the maximum extent permitted by law, Next Level Sports' total liability for any claim related to the platform will not exceed the greater of: • The amount paid by the user to Next Level Sports in the three months before the claim, or • $100 USD Some jurisdictions do not allow certain limitations, so some limitations may not apply to all users.

Sports training, exercise, testing, competition, and physical activity involve inherent risks. These risks may include: • Muscle strain • Joint injury • Overtraining • Fatigue • Illness aggravation • Falls • Collisions • Heat-related illness • Cardiovascular events • Serious injury • Death Users voluntarily assume the risks associated with training, testing, and use of performance programs. Users are responsible for training safely and seeking medical advice when needed.

To the maximum extent permitted by law, users agree to defend, indemnify, and hold harmless Next Level Sports and its owners, officers, employees, contractors, partners, vendors, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from: • User violation of these Terms • User misuse of the platform • User content • User violation of law • User infringement of third-party rights • User misconduct • Coach services provided independently • False performance data • Unauthorized use of athlete data • Unsafe training conduct This indemnity does not apply where prohibited by law.

These Terms are governed by the laws of the State of Florida and the laws of the United States, without regard to conflict-of-law principles. For users outside the United States, mandatory consumer protection laws in the user's country may still apply where they cannot legally be waived.

Before filing a claim, users agree to first contact Next Level Sports at support@nextlevelsportshub.com and attempt to resolve the dispute informally. If the dispute cannot be resolved informally, then to the maximum extent permitted by law, disputes will be resolved through binding arbitration or the courts located in Orange County, Florida, unless applicable law requires otherwise. Users and Next Level Sports agree to bring claims only on an individual basis and not as part of a class action, collective action, or representative action, to the maximum extent permitted by law. Users may opt out of arbitration within 30 days of first accepting these Terms by sending written notice to legal@nextlevelsportshub.com. This section does not prevent users from bringing claims in small claims court where permitted. This section does not limit rights that cannot be waived under applicable consumer protection law.

If users access the platform through Apple App Store, Google Play, or another app marketplace, additional app store terms may apply. If there is a conflict between these Terms and app store terms, the app store terms may control only for app store-related matters.

Next Level Sports may update, modify, suspend, or discontinue any part of the platform at any time. This may include changes to: • Features • Pricing • Subscription tiers • AI tools • Coach tools • Rankings • Testing systems • Profile visibility • Integrations • Mobile app availability Where required, Next Level Sports will provide notice of material changes.

Next Level Sports may update these Terms from time to time. If changes are material, Next Level Sports may notify users by email, platform notice, or other reasonable method. Continued use of the platform after updated Terms become effective means the user accepts the updated Terms. If a user does not agree to updated Terms, the user must stop using the platform.

Users agree that Next Level Sports may communicate electronically through: • Email • Platform notifications • Mobile push notifications • In-app messages • Website notices • SMS where consent is provided Electronic communications satisfy legal communication requirements unless applicable law requires another form.

Next Level Sports is not responsible for delay or failure caused by events outside reasonable control, including: • Natural disasters • War • Terrorism • Labor disputes • Internet outages • Cloud provider failures • Cyberattacks • Government actions • App store actions • Payment processor outages • Power failures • Public health emergencies

If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in effect. The invalid part will be interpreted or replaced in a way that most closely reflects the original purpose while remaining enforceable.

These Terms, together with the Privacy Policy and any additional policies or agreements referenced by Next Level Sports, form the entire agreement between the user and Next Level Sports regarding platform use.

Users must use the platform responsibly, respect athlete data, protect minors, communicate professionally, and understand that training carries risk. Your success is the only level that matters.
